High Court upholds the terms of a shareholders' settlement agreement

A dispute among siblings in respect of shares in the family business resulted in the recent High Court case of Kennedy & Others v Ward. The case illustrates common pitfalls to be avoided when entering into a settlement agreement. It is a good example of the risks associated with entering into a high level agreement without including more detailed provisions on how the agreement is intended to operate.
